2. Scope of these terms
These terms govern access to and use of our website, including its content, enquiry forms, demonstrations and interactive tools.
Where you purchase services, the applicable proposal, order or service agreement will set out the agreed scope, pricing and commercial terms. If it conflicts with these website terms concerning that service, the specific service agreement takes precedence, subject to mandatory law.
We will provide relevant contractual terms before you commit to a purchase. Visiting our website or requesting a demonstration does not, by itself, subscribe you to a paid service.
Nothing in these terms excludes or limits a right, remedy or obligation that cannot lawfully be excluded or limited.
3. Our services
AGS provides customer communication and business automation solutions. These may include:
- Customer relationship management and sales follow-up.
- AI telephone and conversation assistants.
- Appointment and service scheduling.
- Rental availability and reservation processes.
- Event registration, ticketing and attendee communication.
- Websites, landing pages and enquiry forms.
- Marketing communication and review-request workflows.
- Reporting, integrations and workflow automation.
Website descriptions explain possible capabilities. They do not mean that every feature is available, enabled or included in every package.
Availability depends on the selected service, configuration, integrations, permissions and relevant provider or regional requirements.
The agreed service scope will identify what AGS will supply and the responsibilities retained by the customer.
4. Acceptable website use
You may use the website for lawful purposes, including learning about AGS, viewing demonstrations and making genuine enquiries.
You must not:
- Attempt to gain unauthorised access to systems, accounts or information.
- Introduce malicious software or disrupt website operations.
- Submit fraudulent enquiries or impersonate another person.
- Use our forms or communication tools to distribute spam or unlawful content.
- Attempt to extract confidential information through an AI assistant or demonstration.
- Collect or reuse personal information unlawfully.
- Infringe intellectual-property rights.
If you act for a business or another person, you must have the authority required for the request or transaction.
5. Information you submit
Provide accurate information relevant to your enquiry and update it where necessary.
Only submit another person’s information where you have an appropriate lawful basis and authority.
Do not submit passwords, payment-card security codes, confidential credentials or unnecessary sensitive information through ordinary website forms, chat tools or demonstrations.
When you submit material for an enquiry or requested service, AGS may use it to assess and respond to that request, subject to applicable law and our Privacy Policy. This does not transfer ownership of your material to AGS.
Submitting an enquiry does not automatically authorise unrelated marketing.
6. Demonstrations and illustrative content
Demonstrations, sample conversations, booking previews and calculators may use fictional information or simplified processes.
A demonstration does not create a real appointment, rental reservation, ticket, payment or customer record unless expressly identified as a live service and the action is successfully completed.
Illustrative figures and outcomes are not evidence of actual customer performance or guarantees of future results.
An estimate generated by a website tool is not a binding quotation unless expressly stated.
7. AI assistants and automated actions
AGS AI assistants may answer approved questions, collect enquiry information and support configured actions.
AI-generated responses may be inaccurate or incomplete. Important information affecting a purchase, contractual commitment or business decision should be confirmed with an authorised AGS representative.
An AI assistant does not independently have authority to negotiate different prices, waive charges, approve refunds or change an agreement.
A booking or other automated action should only be treated as confirmed when the connected system has successfully completed it and issued the relevant confirmation.
You may request human assistance through our available contact or handover routes. After-hours automated availability does not imply continuous human staffing.
The scope and responsibilities for a paid AI service are governed by the applicable agreement and law.
8. Enquiries and contract formation
Submitting a form, requesting a quotation or booking a free demonstration does not automatically create a paid service agreement.
A paid agreement arises through the acceptance process identified in the relevant proposal, order or checkout. We will make clear when a step creates a payment obligation.
An automatic acknowledgement of an enquiry or order is not necessarily acceptance. The relevant process will identify the confirmation that constitutes acceptance.
For an electronic purchase, you must have an appropriate opportunity to review the transaction, correct errors and withdraw before submitting the final order.
You may retain copies of the terms and confirmations provided to you.
9. Prices, payments and subscriptions
Before you commit to a paid service, AGS will disclose the applicable:
- Scope and material limitations.
- Setup and recurring fees.
- Currency, VAT treatment and other charges.
- Included usage and additional usage charges.
- Relevant third-party costs.
- Payment method and due dates.
- Contract duration, renewal and cancellation arrangements.
- Delivery or implementation arrangements.
- Refund provisions and applicable statutory rights.
A free demonstration does not include free implementation or ongoing platform use unless expressly agreed.
Usage-based services may incur charges for calls, messages, AI processing, payment services or other agreed functions.
No particular contract period, cancellation notice, unlimited allowance or refund guarantee applies merely because it appears in an example.
10. Cancellation, refunds and consumer rights
Cancellation and refund arrangements will be disclosed before purchase and recorded in the applicable agreement. They remain subject to mandatory consumer rights.
Where section 44 of the Electronic Communications and Transactions Act 25 of 2002 applies, an eligible consumer may cancel a service transaction without reason or penalty within seven days after conclusion of the agreement, subject to applicable statutory exclusions.
Where a valid cancellation under that section requires repayment, the statutory refund requirements apply, including the applicable 30-day period.
Other cancellation rights and remedies may arise under the Consumer Protection Act 68 of 2008 or other applicable law.
Requesting early commencement does not remove all consumer rights. Any effect on a particular cooling-off right must be assessed under the relevant law and explained before commencement.
Nothing in these terms makes all payments non-refundable or removes remedies for defective or deficient performance.
11. Implementation responsibilities
The service agreement will define the information, authorised access, approvals and participation required from your business.
These may include approving business information, booking rules, communication content, privacy notices and escalation arrangements.
You remain responsible for business decisions and activities retained within your agreed scope. Examples include physical service delivery, rental handovers and condition inspections, and event operations.
Where AGS processes personal information for your business, the parties must establish appropriate instructions and data-processing arrangements.
These responsibilities do not release AGS from its own contractual or statutory duties.
12. Website availability and accuracy
We take reasonable steps to maintain the website and correct material inaccuracies brought to our attention.
Access may be interrupted by maintenance, network problems, security incidents or other technical issues. We do not promise uninterrupted access to this public website.
We may update website content and features. Changes to paid services or existing commitments must follow the applicable agreement and law.
If a material pricing or service-description error affects an order, we will communicate with you and address it lawfully.
13. Intellectual property
AGS website branding, original text, graphics and other protected material are owned by AGS or used under an appropriate licence. Third-party rights remain with their respective owners.
You may view the content and retain reasonable copies to evaluate our services or maintain transaction records.
You may not reproduce our branding, resell protected material or represent yourself as AGS without permission, except where permitted by law.
Ownership and permitted use of customer-specific websites, workflows, configurations and other deliverables must be addressed in the relevant service agreement. Payment does not, by itself, determine ownership of underlying software or third-party assets.
14. Privacy and communication
Our Automated Growth Systems Privacy Policy explains how we handle personal information, including conversation records, service providers, overseas processing, retention and privacy requests.
The policy should be read alongside any specific recording, cookie or collection notice presented during an interaction. You may request a copy by emailing marketing@growthsystems.co.za.
Agreeing to these terms does not constitute blanket consent to direct marketing, optional tracking or unrelated processing.
Privacy requests and concerns may be directed to:
- Information Officer: J C Oosthuizen
- Email: marketing@growthsystems.co.za
- Telephone: 060 086 8385
15. Third-party websites and services
Our website may link to external websites or use third-party services.
Those providers may have their own terms and privacy notices. Review them where relevant.
A link does not necessarily constitute an endorsement. The involvement of a third party does not remove responsibilities AGS retains under its own agreement or applicable law.
Compatibility, payment availability and integrations must be confirmed for the intended service.
16. Responsibility and liability
The limitations of demonstrations and AI responses described in these terms do not remove AGS’s responsibility for its own conduct or agreed services.
We do not guarantee a particular level of revenue, bookings, lead conversion, search ranking or review volume.
We do not exclude liability for fraud, gross negligence or any other liability that cannot lawfully be excluded.
Any service-specific allocation of risk must be lawful, appropriately disclosed and agreed. Your statutory consumer rights remain unaffected.
17. Misuse and restricted access
We may take reasonable steps to prevent unlawful use, protect information and address security threats, including restricting access to affected website functions.
Where appropriate, we will explain the restriction and provide a route to raise a concern.
Suspension or termination of a paid service is governed by its agreement and applicable law. Restricting access does not extinguish valid privacy, refund or other statutory rights.
18. Complaints and disputes
Send complaints to marketing@growthsystems.co.za, with sufficient information to identify the issue and the outcome you seek.
You may also contact us on 060 086 8385.
We will seek to resolve concerns fairly and within applicable legal timeframes.
You retain the right to approach an appropriate regulator, ombud, tribunal or court. These terms do not require compulsory private arbitration or prevent you from exercising statutory remedies.
Consumer complaints may be referred to the National Consumer Commission where appropriate. Privacy complaints may be referred to the Information Regulator.
19. Governing law
These terms are governed by South African law, subject to any mandatory protections that apply.
Disputes may be brought before a court or other body with lawful jurisdiction. These terms do not require you to waive access to a forum available under applicable consumer law.
20. Updates and remaining provisions
We may revise these website terms and will identify the effective date of the revised version.
Revisions do not retrospectively change an existing service agreement without a lawful contractual basis and any required notice or acceptance.
If a provision is unlawful or unenforceable, it will apply only to the extent permitted by law or be severed where appropriate. The remaining provisions continue to operate where legally possible.
A delay in exercising a right does not, by itself, waive that right.
Contact AGS using the details in section 1 if you need clarification.
